Just for clarity's sake for anyone reading this, they mean "If you sleep with a girl when she says she is drunk you may end up in jail, and therefore this is bad advice"

and not

"if you dont follow this advice you will end up in jail"

Merely being drunk is not enough to get someone thrown in jail. They have to be incredibly drunk. If they can walk without stumbling and give clear enthusiastic consent there is not a single state in the US where you are going to jail.

There are also previous cases when one party was drunk, was verbally able to consent to the act, it was something they never would have done sober, and so claim that even though they did consent they were not mentally fit to consent to anything and those cases have ended in convictions.
