After an SU on my case on 8/26, Emma confirmed that my I-485 has been transferred to the Newark Local Field Office. I’m trying to understand what the timeline might look like from here. Has anyone had experience with EB1A-based I-485 cases being transferred to Newark?

Are there any approvals happening for EB1? Trying to see if USCIS has exhausted number of visas for EB1 category (India) as per their warning in last visa bulletin. Please share if you have had any movement in your case and also mention your category, Received date and Priority date.

Hi everyone,
I filed a lawsuit (mandamus / APA) against the government regarding my pending case. Today, I received an email from the Special Assistant U.S. Attorney (SAUSA) assigned to my case stating:

The government intends to file a motion to dismiss your case. Please let me know when you're available to discuss."

I have a few questions for anyone who has been through this or has experience with government litigation:
1. Why do they want to discuss/call before filing? Is this standard procedure (e.g., meet and confer requirement), or could it mean they are open to negotiating/resolving the issue without going through full litigation?
2. What should I expect during this conversation? What questions might they ask, and is there anything specific I should or shouldn't say?
3. If you've experienced this before, what was your outcome? Did they actually dismiss it, or did it push the agency to take action on the underlying application/petition?
Any insights, advice, or shared experiences would be greatly appreciated. Thank you!

At the end of March 2026, my wife and I filed our I-485 (Adjustment of Status) and I-765 (Employment Authorization) applications based on an approved EB-2 PERM I-140 petition. We completed our biometrics in April 2026. Unfortunately, several months have passed, and there has been absolutely no movement on either of our cases.

In particular, there has also been no progress on my wife’s I-765 application. Both of our cases are still at the National Benefits Center (NBC) and have not yet been transferred to a Field Office. However, I recently learned that our cases have been marked as interview waived.

Lately, I’ve been wondering whether filing an I-131 (Advance Parole) application only for myself might trigger some activity on our pending cases or at least bring them back to an officer’s attention.

Has anyone here had a similar experience? Did filing an I-131 while your I-485 and I-765 were pending result in any movement or faster processing of your cases?

I also asked my attorney about this. He said it’s theoretically possible that filing an I-131 could cause the file to be reviewed again, but he also emphasized that I shouldn’t have high expectations because there is no guarantee.

I’d really appreciate hearing from anyone who has had a similar experience or has any insight into this. Thank you in advance!

I noticed these updates on my I-131 case dated July 22 and July 23. I know there was a USCIS system glitch around that time, which was reportedly fixed later. However, I still don't see any corresponding update in my USCIS portal.

My timeline:

• I-485 and I-765 filed: March 27, 2026
• Category: EB-1A
• Biometrics completed: May 22, 2026
• No other updates since then.

Is anyone else still seeing these API updates without any changes showing up in the USCIS portal?

I did a flagpole at the U.S.-Canada border to complete my Canadian permanent resident landing and was denied admission to the U.S. as part of that process. It was not due to any immigration violation or inadmissibility issue. I am now preparing my I-485 application. Should I disclose this as a denial of admission, and how should I explain it in the Additional Information section? Has anyone had a similar experience?

I have approved EB2 and EB1 before. I am not lawyer but I am willing to answer some questions if this will help anybody from my cases experience. Will try to answer only what I really went through and what happened with me.

As per Emma my case status “Your case is located at SAN JOSE FIELD OFFICE.
Current case status is Resolving Preprocessing Checks.
Case is marked as Interview Waived." This is a local field office for me.

Anyone else in similar boat? I know it says interview waived but is that final? I heard if it’s at local FO there maybe chance of an interview
