Not saying he should starve in the streets, but as long as we’re all on the same page that he created a situation where it’s pretty much guaranteed he will require significant support from others.

I wanna have kids and live a middle class lifestyle and am working hard towards that end and might just make it to that point before im too old to do that. I’m not about to just start having a bunch of kids and put those kids in a bad situation and make others have to provide for me.

I don’t think we should live in a world where having kids is only for the rich, but shit man 4 kids

you're completely right that fathers usually don't want equal custody. in my personal experience and in every other statistic or story i've heard they usually settle for or want whatever is a bit easiest, like weekends or summers. but i have heard of fathers with more or full custody (david sheff the author had his son during the school year and he flew to his moms for summers) and i have met a father who had his child taken from him. i'm from a mother-prefered state, and she was moving far away so the child was kept with her but because of the distance, her feelings toward him, child support that he couldn't really afford, he couldn't see that child at all. but he told me about them, and how he missed them, how when they got a bit older he hoped to reach out to them because the mother had blocked him on everything. it's rare. i don't know exactly why, probably the patriarchy, women usually end up with the brunt of childcare and expenses (unless the father is actually willing to pay child support) like you're right but we really don't know enough about this janitor guy. he literally could've been fine and great with his lady and 4 kids and then she decided she wasn't happy or maybe she genuinely did cheat. maybe she didn't! but it's just possible that he did work to have those 4 kids and that was ripped out from under him, it's rare but it can happen, and if he's making a little apartment for them so he can see them despite being homeless i mean -- my dad hasn't seen me in like 5 years 😅

It is an actual logistical thing that we can’t all just have 4 kids in our teens and early 20s when we’re not financially stable and just expect things to work out.

I know it’s a wealth inequality thing at the top too and I know politically we have issues in the US, but we can’t act like in this case it’s a societal issue only.

Four teenage kids in his mid 30's. He was likely a teenager himself when some or all of them were conceived.

Despite consequences, the fact that he and everybody else deserves a roof over their heads is indisputable. You can say he made his bed. You can say it's his fault. You can go down any road but if it takes you to a place where you think he should be unhoused, you made a wrong turn along the way and should turn back.

That’s the conclusion I’m at as well. It’s not punching down on the guy to point out that he created a situation that will require significant help from social programs. There are others acting like this is purely a societal issue.

There are no public policies that could allow for all of us to barely make any money and all have 4 kids, while still maintaining a quality of life we all believe should be the minimum (roof over our head, clean water, food, healthcare).

It’s a societal issue that this guy doesn’t have a roof over his head but it is an individually caused problem to a degree, but yes we all deserve basic human decency.

There is a nuanced convo to be had, but I am seeing a lot of social justice warriors act like this is purely societal.

Well for one a school isn’t an adequate living space. Mostly because it lacks the proper facilities for living space, but also, What if that area wasn’t in the best condition and he fell or hurt himself while off the clock? Nows caused damage to the school and his body and I highly doubt insurance would cover that. For two he’s not paying for the extra electricity he’s using. Fridges, especially mini fridges, use a lot of power.

Forcing him to be homeless? If you had someone living in your attic, I wouldn’t believe that you would be OK with them staying there and that removing them is YOU causing THEM to be homeless.

If any one of them got hurt on that property they’re gonna have to be responsible for it. If there was a fire or other friends invited…the list goes on. The solution wasn’t for them to keep living in the school.

My grandparents had a lot of children they ended up having to have two jobs each and my grandpa actually had three jobs. Perhaps in order to get out of this situation he’ll have to double up on jobs on the weekdays. Children are expensive.

And this is the largest issue with the political folks and the rich folks bitching about declining birth rates. The middle class is already shrinking year after year, to the point where a decade from now there is going to be no middle class. It'll be low/poverty class and the upper/rich class. So they're already wanting to consign new kids as lower class/poverty class with little avanue to escape from poverty. But then on top of that, they're ensuring that raising even a single kid is more than a lower class family can financially support. When housing just by itself eats up 50% of a family's monthly expenses, no one can afford a kid.

Why mention mom? She’s doing her part by raising the kids almost full time. Her responsibility would be toward her children, not to an ex.

She is the teens’ primary caretaker, and Father gets them on “some weekends” per the article.

This means that he owes the mother financial compensation. The money is for the children- to provide his share of the expenses for the 4 children he helped create. The money isn’t just a bonus for mom, it’s his responsibility to help buy things that are necessary for keeping their children alive and well.

The mother doesn’t owe this man housing, nor should she refuse to take child support from him even if it hurts him, because then the kids suffer.

I do feel horrible for this man. I wish they would’ve employed him as a “nighttime security guard” so he could’ve stayed, as it seemed like he wasn’t hurting anybody.

That means either more hours or another job if more hours aren’t available. There’s no world in which a janitor gets paid more just because he “needs more” than equally competent peers who would have been equally well suited for the same job.

I’m not sure if there is any kind of undue hardship pathway to lower child support payments but it’s those payments that are making him unable to afford housing so the fault lies with him, his ex spouse, and the government.

If he’s just a decent guy who can’t afford to live, it’s a big issue that he can’t afford to live. We shouldn’t have that be a possibility, and it shouldn’t be used as a social punishment. It’s one of the arguments against the death penalty, if somehow the individual put to death happens to be innocent, it means you killed an innocent person.

From personal experience, the system calculates based on gross up to a cap, with a % increase per kid. That % is almost nothing per child when they are all one Dads. Child support isnt what broke him. I bet its the alimoney. The system is structured to incentivize multiple baby Daddies as each is maxed per child based on yhe income of each Dad.

My best friend's dad was actually a janitor when we were growing up. Her mom was a community art teacher & did janitorial work in the summers.

They had a small house and an old car. Kept food in the fridge for three kids + a cat (not the same as 4 kids, I know). But they also smoked like chimneys which has always been heavily taxed in my state. Bet they could've done a 4th if they wanted to.

Did they seem comfortable? Not really. Things were always tight. But the kids were fed, clothed, and managed to get a fair bit of fun stuff like movie rentals and video games.

Yeah, my dumbass uncle had six kids with two different women and was able to support all eight people while working as a mechanic at a gas station. Paid for eight people and two 3-bedroom homes, and still had enough money to buy all sorts of toys (cars).

I can't comment on this guy's specific situation, but 45 years ago things seemed a lot more forgiving.

I handle payroll for my job and we get income withholding orders for employees for child support. We have employees being garnished 65% of wages, that's the limit for our state, so I don't think that's correct.

Technically yes. 65% is the limit. But a judge wouldn't just set the percentage at 65%. They start at 60% and if they are 12 weeks or more late then an extra 5% can be added.

NY has an effective tax rate of ~26%: 20k

Remaining after taxes: 60k

Maximum child support of 60%(could be up to 65!): 36k

Remaining: 24k

So, while not 90% he could only end up with ~30% of his income. Assuming nothing else is taken out for benefits, or whatever.

Keep in mind that "disposable income" means "take home pay", i.e. what he takes home after taxes. It doesn't mean that he gets to subtract rent and car payment. So the guys above you are right. If the court is taking 60% of his janitor paycheck, there is no way he affords an apartment.

It got the ceiling wrong. Someone said its not how child support works, but the idea and sentiment was correct, just not the number. Its not a big deal. The core part of the message was that someone paying child support on 4 kids working a janitor could end up paying so much child support that they would be unable to afford basic housing. At an average custodian salary of $35k/yr, his monthly money in his pocket after 60% child support costs would be <$1000.

Exactly - I would need approx 2 months of rent to pay the lawyer that I absolutely need because my coparent is happy to throw money at this.

Even then - the state just plugs my income into a formula and says "here's the bill, pay it or we'll take it the hard way, good luck."

Yea when I was recently divorced and sober and rebuilding my life making 20k my ex wife was hitting me up for child support while she brought home 500k that year. There is a minimum payment imposed by the court as well despite the obvious disparity.

I’m making much more now. And she’s laid off. So there’s that.

The minimum payment in my state is $50, and it's mostly so they can keep track of the parent and where they're working. I really think people ought to be able to contribute $50 to their child's wellbeing.

bro if I had 60% of my paycheck taken I wouldn't be able to pay rent anywhere in my city even if I split a tiny room with multiple people lol. Then taxes and utilities and then ALSO pay for food if you have dual custody of said kids. Btw I work full time with an above average salary.

thats fucking bananas anybody would think that is survivable. It feels like a limit set when rent or housing didn't take 30-50% of your income ALONE

That's not my argument. And 60% is the upper limit. My argument is the government won't take more than the federal limit of 60% or 65% if they are late 12 weeks or more.

$80k a year income would be about $62,000 net, if the kids are not living with him most of the time he probably cannot claim them as dependents.

$62,000 x .40 = $24,800 a year for him to cover his own housing, food, etc.

If he was behind on child support it can increase to 65% garnishment, so he would have $62,000 x .35 = $21,700 a year for his own housing, healthcare, food, etc.

The national average for a 1-room apartment is $1,664 a month or $19,968 per year.

This would leave $1,732-$4,832 annually for food, medical, etc or $33.30-$92.92 a week, assuming he was somehow saddled with the maximum % for child support.

Do you understand how percentages work? The maximum child support that can be used from any one person's paycheck is 60% of the amount of the check.

 Doesn't matter how many kids, it just means he'll owe back support if it's not enough to cover but they can only garnish up to 60% of wages.

The court takes into consideration your finances and generally does not make you pay more than you can afford. Also kinda seems like his kids are usually with the mom, which implies she has more money and therefore would be the one paying child support (if anyone is at all bc that's not always the case)

I mean how can we say consequences of his actions when we dont know what caused him to be single in the first place. When you pay child support youre basically paying for your ex to have a house while still having to provide a second home just to be allowed to see your kids. And then insane lawyers fees if you dont want to be completely taken to the cleaners

My dads second wife turned into a complete monster when their son was born. Then when they split she tried to not even let him see him, all the while he had to keep giving her money. When he turned 14 he went to the courts himself to get them to give my dad full custody, but funnily enough she wasnt required to pay him anything after that

Callous of you to presume that it was his fault in the first place. There are scenarios where the wife may have been the catalyst for the divorce and he's still on the hook for child support, not to mention giving up half his assets. Sometimes events in your life can spiral with one negative leading to another, when you may not necessarily have triggered it in the first place. It's better to show empathy and make no assumptions. I'm not justifying breaking the law, but I also assume nothing.
